This document regulates the conditions under which Pedro Castro Piñeiroa offers users access to and use of the website https://pcastrop.com and the sale of artworks through it, in compliance with the provisions of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), and other applicable regulations.

2. Purpose

The purpose of this website is the sale and dissemination of artworks.

3. Purchasing Process

  1. Selection of Works: Users can browse and choose the available artworks on the website. Each artwork is presented with a description, images, and price (including IGIC). All artworks are unique and original.
  2. Shopping Cart and Order Confirmation:
    • Selected artworks will be added to a “shopping cart.”
    • Once the selection is complete, the user will proceed to request the purchase through the indicated form.
    • The order will be considered formalized only once the user receives a confirmation email sent by Pedro Castro Piñeiroa to the provided email address.
  3. Payment: Accepted payment methods are: credit/debit card and PayPal. Payment will be made at the time of order confirmation, before shipping.
  4. Availability and Shipping: The availability of the artworks will be indicated on the corresponding page. Shipping will be made to the address provided by the buyer and will be carried out within the timeframe indicated at the time of purchase, unless otherwise agreed. Due to the nature of the medium used for each artwork, shipping costs will be borne by the customer and will be calculated during the shipping process, depending on the type of packaging.

4. Prices

All prices are shown in euros (€) and include applicable taxes (IGIC). Shipping costs will be detailed separately during the purchase process.

5. Guarantees

  1. Legal Guarantee::
    Pedro Castro Piñeiroa guarantees the quality and certified origin of the artworks. Pedro Castro Piñeiroa ensures that the artworks for sale are unique and his property. Each artwork will be accompanied by a certificate of authenticity, signed by the artist.
  2. Defects and Non-Conformity:
    If any defect is detected in the artwork, the buyer must notify it in writing to info@pcastrop.com within 5 days of receipt, providing photographs or any evidence that demonstrates the defect. Pedro Castro Piñeiroa commits to managing the claim in accordance with current regulations.

6. Returns

  1. Return of Works:
    1. If the artwork does not meet the customer’s expectations, it can be returned to Pedro Castro Piñeiroa.
    2. The artwork must be returned in the same condition it was received, without being damaged or used in a way that prevents its proper return.
    3. Return shipping costs will be borne by the buyer, unless it is a defective product or incorrectly delivered. Works that have been specifically created for the buyer cannot be returned.
  2. Refund:
    Once the returned artwork is received and verified, Pedro Castro Piñeiroa will proceed to refund the amount paid, including shipping costs if applicable, within a maximum period of fourteen (14) calendar days, using the same payment method used in the original transaction, unless another method has been agreed upon.

7. Data Protection

The personal data provided by the buyer will be incorporated into a file owned by Pedro Castro Piñeiroa, whose purpose is the management of orders and the commercial relationship, as well as sending commercial communications if the user has given prior consent. The collection and processing of data will be carried out in accordance with the provisions of Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights.

8. Intellectual Property

All content (texts, photographs, designs, logos, etc.) present on this website is the exclusive property of Pedro Castro Piñeiroa. Total or partial reproduction is prohibited without the express authorization of the owner.

9. Applicable Law and Jurisdiction

The relationship between Pedro Castro Piñeiroa and the buyer shall be governed by Spanish law in force, in particular by the General Law for the Defense of Consumers and Users, the Law on Information Society Services and Electronic Commerce, and any complementary regulations.

10. Modifications

Pedro Castro Piñeiroa reserves the right to modify, at any time, the presentation, configuration, and content of this website, as well as these General Conditions. Modifications will be published in this document and will apply to purchases made from their publication.

For the resolution of all disputes or issues related to the interpretation and/or execution of these conditions, the parties expressly submit to the Courts and Tribunals of Santa Cruz de Tenerife, unless the applicable law provides otherwise.
